- MEMBERSHIP TERMS AND CONDITIONS
These Terms and Conditions have been prepared by Educated Body (trading name of Raw Corporate Health Ltd) to govern the relationship between you, us, and Chesterford Research Park for the provision of the Nucleus Gym and Golf Course services to you and your use of these services at Chesterford Research Park, which you have joined and the terms of your membership fees.
ACCEPTANCE AS A MEMBER
Under the terms of our agreement with Chesterford Research Park we have been granted an absolute discretion to enter into this agreement with you and to accept your application for membership at Chesterford Research Park Nucleus Gym and Golf Course. Authorised access to Chesterford Research Park Nucleus Gym and Golf Course will only be given on completion of an online video induction and then granted to you.
MEMBERSHIP
You must be at least 18 years old to be a member of Chesterford Research Park Nucleus Gym and Golf Course. The facilities can be exclusively used by the members of the Chesterford Research Park Nucleus Gym and Golf Course.
You accept that the Chesterford Research Park Nucleus Gym and Golf Course is not staffed during all Nucleus Gym and Golf Course opening hours and that it is your personal responsibility to stop exercising in the gym or using the golf facilities if you feel unwell or require assistance.
As a member you agree to familiarise yourself with the rules and regulations of membership which are displayed on the Chesterford Research Park Nucleus Gym and Golf Course website. Among others, the rules and regulations provide information about the opening hours, use of the facilities and your conduct. We and Chesterford Research Park may make reasonable changes to these rules at any time.
You agree to comply with the rules and regulations, terms of this membership agreement and then current rules of the gym as may be amended by us or Chesterford Research Park from time to time at discretion throughout the terms of your membership.
You must observe all instructions regarding the safe and proper use of the gym and golf course at all times, recognising that the gym and golf course will be unsupervised, and you should not use the fitness equipment with which you are unfamiliar or in respect of which you have not received an induction.
In addition, you need to familiarise yourself with the safety features provided at the gym to be able to get assistance due to the gym being unsupervised and follow appropriate safety considerations when using the golf course which is unsupervided.
It is the intention that all the terms of a financial contract between the member and Chesterford Research Park Nucleus Gym and Golf Course are contained in this document and agreed directly between us and you. Any amendments or additions to this contract must be in writing and signed by the relevant parties.
MEMBERSHIP FEES
Your membership of Chesterford Research Park Nucleus Gym and Golf Course is on a rolling 1 month basis and membership prices are displayed inside MBO.
Payment will be collected on the day your membership starts and will be collected on or around the same date of every month.
From time to time, we may increase the monthly membership fee. We will give you at least one month’s notice in writing of any proposed increase in the membership fee. If you do not agree to pay the new fee, you may terminate this agreement by notifying us by email or in writing to cancel your monthly membership fee payments, giving 1 calendar months’ notice. Please note that directly cancelling the payment of fees with your bank or credit card company is not sufficient and does not constitute service of written notice.
As part of the service provided to the Client, Educated Body manages the collection of membership fees payable from time to time by members. For VAT purposes Educated Body is acting as a Disclosed Agent for the Client which effectively means Educated Body is collecting the funds on the Client’s behalf and is not responsible for remitting the VAT on this income. For the avoidance of doubt, these funds are returned, net of Educated Body’s fees only, and there is no VAT accounted for by Educated Body and this is reflected in the return of funds to the Client free of VAT.
TERMINATION OF MEMBERSHIP
Your membership will continue on a 1 month rolling basis unless properly terminated by you or us within that period in accordance with the sections below.
We may end this agreement at any time after sending you a default notice in writing:
(a) If you commit a serious breach of this agreement or the Chesterford Research Park Nucleus Gym and Golf Course rules of membership and the breach, if applicable of remedy, is not remedied within 7 days after the date of receipt of a default notice.
(b) If you commit a series of 3 repeated breaches within a period of 6 months, regardless of whether these breaches are remedied, or not.
(c) If any monthly membership fee payment remains unpaid 14 days after the original due date for payment is not paid within 7 days of a default notice.
(d) If you provide us with details which are false where applying for membership and the false declaration would have reasonably affected our decision to grant you membership.
(e) If we end this agreement for any of these reasons, apart from any other legal rights we may have against you, we may require you to pay compensation for debt recovery costs in line with the late payment legislation and
charge interest on all sums outstanding at the rate of 4% above the base rate of HSBC. It is further agreed in the event we have to take further legal action to recover any outstanding fees on this contract; the member/s will
be responsible for those costs that are incurred by us in taking such action, which includes Collection Agency fees, tracing fees, legal fees and any additional costs pertaining to this claim.
(f) If we end your membership, or you end your membership in accordance with the termination rules, it is your responsibility to cancel your payment arrangements.
(g) You are required to give one months notice when cancelling your Chesterford Research Park Nucleus Gym and Golf Course membership, Cancellation must be given in writing and it is the responsibility of the gym member to log into their MBO account and cancel their membership within their profile on the MBO website
(h) You or we may end your membership at any time if we close the club unless the closure is forced upon us by a force majeure event. Force Majeure event is the type of event that neither party is unable to prevent or provide against by the exercise of reasonable diligence, including (but not limited to) acts of God, civil commotion, military or terrorist activity, sabotage, floods, unusually severe weather conditions which could not reasonably have been anticipated, lightning, fires, explosions or other catastrophes, lockouts National or other strikes or any other concerted acts of workmen or other similar occurrences in their industry other than strikes or concerted acts by our personnel. We reserve the right to end your membership at any time and we will notify you in advance.
(i) If we end your membership, we will refund any part of your membership fee which you have paid in advance but which relates to a period after termination. We may deduct from any such refund any money due from you to us.
(j) Once your membership has ended you will no longer be entitled to use the Chesterford Research Park Nucleus Gym and Golf Course, your access will be stopped.
- TERMS AND CONDITIONS FOR ONLINE PURCHASES
If any classes or event incur a charge:
- All payments for any Educated Body hosted events must be made online via the Educated Body web portal. Cash is not accepted.
- Any other classes or events hosted by external third parties are to be paid directly to the third party via their terms and conditions.
- PERSONAL TRAINING BOOKINGS AND PAYMENTS:
Personal Training is sold at the time of booking. Payment for personal training is to be made directly to any Educated Body approved personal training service provider.
All personal trainers must be approved by Educated Body and Chesterford Research Park and must sign in and out at the Gatehouse before accessing the gym with the resident.
All person trainers must be appropriately qualified, first aid trained and insured at all times and must send copies of this information to Chesterford Research Park This information will be held by Chesterford Research Park. and will need to be updated as required. Failure to do so will result in the personal trainer being unable to access the gym.
Educated Body bear no responsibility for any refunds due for personal training session. The cancellation policy is set by the individual personal trainer and the resident. This Agreement is only between the resident and the personal trainer.
Only Chesterford Research Park Nucleus Gym Members can be personal trained or access and use the gym at any time. Non-members can NOT use or access the gym at any time.
- CHESTERFORD RESEARCH PARK NUCLEUS GYM AND GOLF COURSE MEMBER EVENTS CANCELLATION POLICY
The cancellation policy for all events is 4 hours prior to the start of the of the event. This allows for the space to be offered to anyone on the wait list. For the avoidance of doubt, and by way of example. if you have a booking at Midday then the cancellation must be made by 08:00 the same day.
The rights of cancellation and any limitation expressed in these terms and conditions do not affect your statutory rights as a consumer.
- REFUNDS
Any chargeable events’ refunds in relation to any payments made to Educated Body may only be credited to the credit or debit card originally used to make the purchase.
Refunds for medical reasons will be considered on a case by case basis and will need to be supported by an appropriate Doctor’s certificate outlining the reason why you should not continue to exercise.
Any costs associated with obtaining the medical certificate will be solely the responsibility of the customer.
- FITNESS CLASS BOOKINGS
All fitness classes require you to book directly with the class facilitator, all payments must be agreed with and paid directly to the class facilitator as per the facilitators own terms and conditions. Should you be unable to make the class please always cancel within the allocated notice period to enable another member on the waitlist to be given the space.

Although care has been taken to ensure technical and factual accuracy, some errors may occur. No guarantee is given of the accuracy or completeness of information on these pages. Educated Body shall have no liability arising from the use by any party of the information on this web site.
